Terms of Service

By accessing or using LeadPulse AI ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms.

If you do not agree to these Terms, do not access or use the Service.

LeadPulse AI is a SaaS platform that connects to automotive dealership email inboxes, reads inbound lead emails, and uses artificial intelligence to generate draft responses and follow-up messages. The Service integrates with Gmail and Microsoft 365 via OAuth and is subject to those providers' terms and policies.

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

The Service is offered on a subscription basis. Subscriptions are billed monthly at the rates listed on our pricing page. All fees are non-refundable except as required by applicable law. We reserve the right to change subscription prices with 30 days' notice.

Failure to pay may result in suspension or termination of your account. You authorize us to charge your payment method on file for all recurring subscription fees.

You agree not to use the Service to:

• Violate any applicable law or regulation
• Send spam, unsolicited messages, or misleading communications
• Transmit false, misleading, or deceptive content
• Interfere with or disrupt the integrity or performance of the Service
• Attempt to gain unauthorized access to the Service or its systems
• Use the Service to process data for any purpose other than automotive lead management

The Service uses artificial intelligence to generate draft email responses. These drafts are provided for review purposes only. LeadPulse AI does not guarantee the accuracy, completeness, or suitability of AI-generated content. You are solely responsible for reviewing, editing, and approving any content before it is sent to a customer.

Important: LeadPulse AI does not verify vehicle availability, pricing, or inventory. AI-generated responses may not reflect current inventory status. You must not rely on AI-generated responses as representations of vehicle availability.

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our collection and use of data as described in the Privacy Policy.

You represent that you have obtained all necessary consents and have the legal right to connect email accounts and share data with the Service.

The Service and its underlying technology, including software, algorithms, and interfaces, are owned by LeadPulse AI and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Service during your subscription period.

You retain ownership of all data you provide to the Service. You grant LeadPulse AI a limited license to process your data solely to provide the Service to you.

To the maximum extent permitted by applicable law, LeadPulse AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.

Our total liability to you for any claims arising under these Terms shall not exceed the total fees paid by you to LeadPulse AI in the three months preceding the claim.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

Either party may terminate these Terms at any time. Upon termination, your right to use the Service ceases immediately. We may suspend or terminate your account for violation of these Terms, non-payment, or any other reason at our sole discretion with reasonable notice.

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the courts located in Delaware.

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the Service. Continued use of the Service after such changes constitutes your acceptance of the updated Terms.
